Terms of use

Who provides the service

The service is published and operated by Vincent Acard, sole proprietor trading as SetScale (SIREN 502 384 027, RCS Nanterre, 21 rue d'Arcueil, 92120 Montrouge, France; full details in the legal notice). Contact: privacy@setscale.io. Application hosting: Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States. Creating an account or subscribing means you accept these terms.

What the service does

SetScale connects your Instagram, Messenger and WhatsApp accounts through Meta's official APIs, replies to the prospects who write to you, asks the qualifying questions you wrote, and books calls in the calendar you connected. Everything it says comes from the script and the knowledge you configured.

The AI is off by default on every channel. Nothing is answered until you switch it on, and you can pause it, take any conversation back, or switch it off again at any time.

Your account

You are responsible for your credentials and for everything done from your account, including by the people you invite. You choose their roles and you can remove them. You must be at least 18 and use the service for a professional activity.

Subscription, trial and billing

  • The subscription is monthly and billed per account, not per user. The plan sets your monthly allowance of AI messages.
  • Starter is billed immediately, on the day you subscribe. There is no trial on that plan.
  • The other plans come with a 7 day free trial. A card is required to start it, $0 is charged on day one, and the first payment is taken at the end of the trial unless you cancel before.
  • Payment, invoices and the trial are handled by Stripe. We never see or store your card number.
  • You can change plan or cancel at any time from the billing page, which opens the Stripe portal. A cancellation takes effect at the end of the period already paid.
  • A started month is not refunded. Changing plan mid-period is prorated by Stripe.

The message allowance

Each plan includes a number of AI messages per month. When the allowance is reached, the AI pauses: it stops replying rather than billing you for something you did not choose. Your inbox keeps working, and you or your team can still reply by hand to every conversation. The allowance resets at the start of each billing period, and you can move to a higher plan at any time.

Acceptable use

You agree to use SetScale to answer people who wrote to you first. Specifically:

  • no cold outreach to people who never contacted you;
  • no spam, no mass unsolicited messaging, and respect for Meta's platform policies, including the 24 hour messaging window and template approval;
  • no illegal, deceptive, hateful or fraudulent content, and no offer you are not entitled to sell;
  • no attempt to disable or weaken the AI disclosure or the STOP opt-out. Both are part of the product and are not optional;
  • no sharing of a third party's password: channels are connected through the official login and can be revoked by their owner.

You configure the AI, you supervise it

SetScale provides the tool. The script, the offer, the prices, the promises and the qualifying questions are yours. The setter works from what you wrote, and it is your job to read conversations and correct the script when it misses.

Consequently we do not guarantee any commercial outcome, we make no promise on the number of calls booked or held, and we are not liable for the content of the replies produced from your configuration. An AI can make mistakes: every conversation is readable in full so you can catch them.

Dependence on the Meta platforms

Instagram, Messenger and WhatsApp are operated by Meta, under their rules, their validation process and their quotas. A change on their side, a suspension of your account or a policy update may interrupt a channel or a feature without notice and without that being our doing. Where possible we will tell you, but we cannot guarantee the continuity of a platform we do not own.

Availability and liability

The service is provided on a best efforts basis. We do not commit to a contractual availability level and maintenance may interrupt it. To the extent permitted by law, our liability is limited to the amounts you paid over the twelve months preceding the event, and we are not liable for indirect damage such as lost profit, lost opportunity or lost clients.

Suspension and termination

We may suspend or close an account that breaches these terms, endangers a Meta connection, or is used for abuse, without refund of the period in progress. You may close your account at any time by deleting your organisation from the settings, which deletes its data as described in our privacy policy.

Intellectual property

The SetScale product, its site, its brand and its code belong to us. Your data, your scripts and your conversations belong to you. We do not sell them, and we process them only to deliver the service, as described in our privacy policy.

Changes to these terms

These terms may change as the product does. The date at the top is the one that counts, and a material change will be announced by email. Continuing to use the service after such a change means you accept the new version.

Governing law

These terms are governed by French law. Any dispute that cannot be resolved amicably falls under the jurisdiction of the competent French courts.
